This Privacy Policy explains how EMAYA Sàrl (“EMAYA”, “we”, “us” or “our”) handles personal data when you visit our website at www.emaya.ch (the “Site”), purchase from us, or otherwise deal with us (together, the “Services”). Throughout this document, “you” refers to anyone whose personal data we process under this Policy – whether you are a customer, a visitor to the Site, or someone who contacts us in another capacity.

We process personal data in accordance with the Swiss Federal Act on Data Protection
(FADP) and its implementing Ordinance. Where we offer goods or services to individuals in the European Economic Area, the EU General Data Protection Regulation (GDPR) may
apply in addition; in that case we comply with it as well.

Please read this Policy carefully. By using the Services, you acknowledge the processing of your personal data as described here. If you are not comfortable with it, please refrain from using the Services.

Who is responsible for your data

Updates to this Policy

We may revise this Policy occasionally – to reflect changes in how we work, or for
operational, legal or regulatory reasons. When we do, we will publish the new version on the Site, update the date above, and take any further step the law requires. We encourage you to revisit it from time to time.

The personal data we collect

The data we hold about you depends on how you interact with us. By “personal data” we
mean any information relating to an identified or identifiable individual. We gather it from three main sources, described below.

Data you give us directly.

When you use the Services, you may share with us, among other things:
• Contact details – your name, postal address, telephone number and email.
• Order details – billing and shipping addresses, confirmation of payment, and the contact information tied to a purchase.
• Account details – username, password and any security questions.
• Shopping activity – the items you look at, add to your basket or save to a wishlist.
• Support exchanges – whatever you choose to tell us when you get in touch, for instance through a message form.

Some features only work if you provide certain details. You are free to withhold them, but that may limit your access to those parts of the Services.

Data collected automatically.

As you browse, we gather information about how you use the Services (“Usage Data”) through cookies, pixels and similar technologies (“Cookies”). This can include your device and browser, details of your network connection, your IP address, and how you move through the Site. The “Cookies” section below explains your choices.

Data from third parties.

We also receive information about you from partners and service providers acting for us,
such as:
• the platforms that run our Site and Services (for example, our e-commerce provider);
• our payment processors, who collect the payment details (such as card or bank information and billing address) needed to take payment and fulfil your orders under our contract with you; and
• tracking technologies – pixels, web beacons, SDKs, third-party libraries and cookies – that we or our partners use when you visit the Site, open our emails or engage with our ads.

Anything we receive from third parties is handled under this
Policy. We cannot vouch for the accuracy of data others give us, nor for those third parties’ own practices; see “External sites and links” below.

How and why we use your data

We rely on the legal bases set out in the FADP – principally the performance of
our contract with you, your consent where we ask for it, and our legitimate interests in running and improving our business, balanced against your rights. Specifically, we use your data to:
• Run the Services – take payment, process and ship your orders, han
dle returns and exchanges, manage your account, send you transaction and account notifications, and let you leave reviews.
• Market our products – send you offers and promotional messages by email, SMS or post, and tailor the advertising you see on our Site and elsewhere, where this is permitted and subject to your choices.
• Keep things secure – detect, investigate and respond to fraud, misuse or unlawful activity. If you hold an account, please keep your credentials private and tell us at once if you think it has been compromised.
• Support and improve – respond to your enquiries and refine the Services, in our legitimate interest in being helpful and maintaining our relationship with you.

Cookies
Like most websites, we use Cookies on the Site – to make it work and improve it (including remembering your preferences and actions), to run analytics that help us understand and optimise how the Services are used, and to allow selected partners to tailor content and advertising. Details of the Cookies tied to our e-commerce platform are available from that provider’s own cookie notice.

Browsers usually accept Cookies by default, but you can set yours to block or remove them. Doing so may degrade your experience and stop some features working properly, and it may not, on its own, prevent every form of data sharing with partners such as advertisers. 

When we share your data

We disclose personal data to third parties only for legitimate purposes consistent with this Policy, in particular:
• to service providers acting on our behalf – for IT, payment processing, analytics,
customer support, cloud hosting, fulfilment and shipping;
• to business and marketing partners who help us provide and promote the Services, each using your data under their own privacy notices;
• where you ask us to or agree that we should – for example to ship to you, or through
social media widgets and login integrations;
• within our corporate group, in our legitimate interest in operating efficiently; and
• in the context of a corporate transaction (such as a merger or insolvency), to meet legal obligations (including responding to lawful requests from authorities), to enforce our terms, or to protect our rights and those of our users and others. 

We do not use or disclose sensitive personal data to infer characteristics about you, and we do not sell your personal data.

Reviews and content you post
The Services may let you publish reviews or other content. Anything you post in a public area becomes visible and accessible to others. We cannot control who sees it or how they use it, and we are not responsible for the privacy, security or accuracy of information you choose to make public or that you exchange with third parties. 

External sites and links
The Site may link to platforms run by others. If you follow such a link, please review that
site’s own privacy terms – we do not control them and cannot guarantee their privacy,
security or the reliability of their content. Information you share in public or semi-public
spaces, including third-party social networks, may be seen and used by others without
restriction. A link from us does not imply endorsement, unless we say so.

Children
The Services are not aimed at children, and we do not knowingly collect their personal data. If you are a parent or guardian and believe a child has given us their data, please contact us at the address below and we will delete it.

Security and how long we keep your data
No system is ever completely secure, and we cannot promise “perfect security” – nor is data necessarily safe while travelling to us, so please avoid sending sensitive information over unprotected channels. We take appropriate technical and organisational measures to protect the data we hold.

How long we retain personal data varies with the purpose: whether we still need it to run your account, deliver the Services, meet legal obligations, resolve disputes, or enforce our agreements and policies. When we no longer need it, we delete or anonymise it.

Your rights
Under the FADP, and subject to its conditions and exceptions, you may:
• Access – ask whether we process data about you and obtain a copy, together with
information on how we use and share it.
• Rectify – ask us to correct data that is inaccurate or incomplete.
• Delete – ask us to erase data we hold about you.
• Obtain portability – receive certain data in a common electronic format, or have it handed over to another controller, where the law provides.
• Object and restrict – ask us to stop or limit a given processing, including processing for direct marketing or profiling.
• Withdraw consent – where we rely on your consent, take it back at any time, without affecting processing already carried out.
• Manage communications – unsubscribe from promotional messages at any time via the link in our emails; we may still send you service messages about your account or orders.

To exercise any of these rights, contact us using the details below. We will not treat you
unfavourably for doing so. We may need to confirm your identity – for instance via your email or account details – before we respond, and we will reply within the time the law allows.

Complaints
If you are unhappy with how we handle your personal data, please tell us first using the
contact details below so we can try to put things right. You also have the right to refer the matter to the Swiss Federal Data Protection and Information Commissioner (FDPIC), or, if you are in the EEA, to your local data protection authority. 

International transfers
We may store and process your personal data outside Switzerland, including in countries whose data protection laws differ from Swiss law, and our staff, service providers and partners in those countries may process it too.

Where we transfer data to a country that the Swiss Federal Council has not recognised
as providing adequate protection, we put appropriate safeguards in place – typically the Standard Contractual Clauses recognised by the FDPIC (or an equivalent mechanism) – so that your data remains protected.
